After the buyer has proposed the offer and after its acceptance by the vendor a preliminary contract which is called Compromesso di Vendita, is drawn and signed by both parties.
The Compromesso di Vendita, drawn by the estate agent, will contain:
the details of the parties
the details of the property
the price agreed
the deposit (generally from 15% up to 25% of the agreed price)
the terms of sale
the name of the notary public (suggested by the buyer)
the date of the final contract (the deeds of property)
The notary assures the regularity of the transaction, he will look after its registration, he will collect on behalf of the government the purchase taxes (according to the Finanziaria 2007 comma 309, the registration tax of 10% or 4% if you become a resident, is paid on the cadastral or fiscal value of the property, 17% if the property is agricultural land).
The balance of the purchase price and the fees will be paid on completion.
The notary fees are approx 2,5 -3% plus VAT (if due for law) of the declared purchase price with a minimum of 1,500 euros.
In Italy there is no wealth or inheritance tax.
Capital gains have to be paid if the property is sold within five years from purchase.
